1.1. These general conditions of sale (hereinafter, "Conditions") govern all sales of Sognidicristallo products (hereinafter "Products" or "Product") made through the use of the website www.sognidicristallo.com.
1.2. These Conditions apply to contracts for the purchase of Products made remotely, or in any case outside the business premises, between Sognidicristallo (hereinafter also referred to as the "Seller") exclusively with subjects defined as consumers, who purchase the Products for personal use (hereinafter the "Customer" or the "Customers"). A consumer is understood to be any natural person who acts, for purposes not related to their commercial, entrepreneurial, craft or professional activity, over 18 years of age (or who in any case are considered to be of legal age according to the law of their country) or even minors, provided they are authorised by their legal representative.
1.3. The resale or sale of the Products purchased on the Website is expressly prohibited when carried out for commercial or professional purposes.

1.5. Sognidicristallo reserves the right to modify and/or supplement these Conditions at any time. The purchase of the Products is governed by the Conditions of Sale on the Website and in force at the time of purchase; the Customer is required, before making any purchase on the Website, to carefully read these Conditions.
Any modification, integration or replacement of these Conditions with an updated version implies the automatic inapplicability, ineffectiveness and unenforceability against Sognidicristallo of these current ones in relation to purchases made at a time subsequent to such modification, integration or replacement.
2. INFORMATION RELATING TO THE SELLER AND THE PRODUCTS
2.1. The Seller is SOGNI s.r.l., an Italian company, with registered office in Via Castellantico 17 Mirano 30035 (VE) VAT number and Tax Code no. 04513400277, registered with the Venice Business Register.

2.3. Information relating to our Products, in particular a description of the Product, the relevant technical specifications of the Product and any options (such as, for example, the number of lights, colour, dimensions etc.) relating to the Product are available on the Website.
2.4. The representation of the Products as displayed on the Site may differ from reality; the Customer, before proceeding with the purchase, must therefore rely on the description of the Product and the information related to it.
2.5. In any case, Sognidicristallo cannot be held responsible in any way for any errors deriving from the failure of the Customer's connection to the Site.
3. CONCLUSION OF THE CONTRACT
3.1. Before sending an order proposal, the Customer is required to carefully read the item characteristics and its price, as well as any other information regarding the Product on the Site, specifically indicated on the pages relating to each individual Product. The Customer is also required to carefully read these Conditions and the instructions provided during the purchase procedure.
3.2. To purchase the products, the customer must perform the following steps: (i) enter the chosen Products in the "Shopping Cart" by selecting the appropriate button; (ii) select the "Proceed to Checkout" button and fill in the required mandatory fields (Order Proposal); (iii) select the payment method; (iiii) accept the general conditions; (iiiii) transmit the order proposal through the Site.
3.3. Before submitting the Order Proposal, the Customer must verify all the data entered and, where necessary, may make any corrections and/or changes. Following confirmation of the Order Proposal, the order is sent to Sognidicristallo to be processed and can no longer be modified.
3.4. The contract stipulated between Sognidicristallo and the Customer must be considered concluded when the Customer receives one or more confirmation emails (hereinafter the Confirmation email) from Sognidicristallo. The Confirmation email will be sent to the address provided by the Customer during the Checkout procedure and will contain the order confirmation, as well as a summary of the purchase conditions governing the order (such as: description of the Product; total price; contacts details for any complaints and more generally the information relating to our after-sales service; the existence of the right of withdrawal and how to exercise it).
3.5. In any case, Sognidicristallo reserves the right not to accept an order proposal issued by a Customer in the following cases: (i) in the event of unavailability of the Products; (ii) in cases where suspicion or a report of fraudulent or illegal activity exists or in cases where there is a suspicion that the Products are purchased for commercial purposes; (iii) if the Customer on previous occasions has not complied with our General Conditions of Sale and has not fulfilled its obligations. In these cases, Sognidicristallo will forward an email cancelling the orders received within 30 (thirty) days of receipt of the Order Proposal.
3.6. Once the Order Confirmation email is received, the order can no longer be cancelled or modified. Any return of the products must be carried out in the manner provided for in point 7 of these Conditions.
3.7. The risk of loss or damage to the Products purchased is transferred to the Customer when the latter, or a third party designated by them other than the carrier, materially comes into possession of the Products.
4. PRICE AND METHOD OF PAYMENT
4.1. The price of the Products indicated on the Site is expressed in Euros and also includes all applicable taxes and duties as well as any shipping costs, where applicable, which will be indicated separately. In any case, for any additional cost, Sognidicristallo will request the express consent of the Customer.
4.2. Although Sognidicristallo assiduously verifies the accuracy of the prices indicated on the Site, it cannot guarantee the absolute absence of errors. In the rare event that there is an error in the indication of the price of a Product, we will immediately reject the order, providing the Customer with the opportunity to purchase the Product at the correct price. If the error is found after the order has been accepted, we will immediately report it, offering the Customer the opportunity to cancel the order.
4.3. The Customer will be charged the price shown on the Cart at the time of confirmation made by selecting the purchase Button
4.4. Our Products can be purchased via various payment methods. The Customer may effect payment of the amount due and shipping costs, where applicable, by:
● Bank transfer: the details for the transfer of the amount due will be sent to the Customer as soon as the order is completed. Payment must be made no later than ... working days from the date of order confirmation. In the event that, after this period, the funds corresponding to these amounts are not showing on the current account indicated, Sognidicristallo will not execute the contract and it must be considered cancelled;
● Paypal: the Customer can pay the amount due through their Paypal account or by credit card through the safest online payment system in the world;
● Credit card: the Customer may use their credit card (VISA, Mastercard, American Express) directly through our Site;
● Cash on delivery (ONLY for deliveries in Italy): 100% cash on delivery is only possible for amounts less than 1000 euros in cash to the courier. For larger amounts you will be contacted by our team once the order is confirmed.
● Other methods: to meet your needs, Sognidicristallo reserves the right to accept additional payment methods. In these cases, please contact us once the order has been confirmed.
4.5. In the event that the Customer uses a credit card as a payment method, they confirm and guarantee that they are the owner of the credit card used and certify the accuracy of the data entered at the time of purchase such as: the number, the expiration date and, where necessary, the security code. In any case, Sognidicristallo will charge the transaction to the customer only after verifying the following conditions: (i) credit card data; (ii) receipt of the debit authorisation by the issuing company for the credit card used by the Customer; (iii) confirmation of the availability of the Product by Sognidicristallo and in any case after the order is ready to be processed.
4.6. For the purposes of payment by other methods, the Customer confirms and guarantees that they are the owner of the account used for the purchase.
4.7. The shipment of the purchased Products will only be made following succefsful payment of the fee due by the Customer. In the event that payment, for any reason, has not been effective, Sognidicristallo will send a communication to the customer informing them of the cancellation of the sale.
4.8. For each successful order, an invoice will be issued and sent to the Customer by email or by post in compliance with current legislation. The invoice will be issued on the basis of the information provided by the Customer at the time of the order. No changes to the invoice will be allowed after the invoice has been issued.
5.1. Each product is professionally packaged through the use of special vacuum blisters covered with polystyrene and stored in triple-layer cardboard boxes. In the rare event of breakage during transport, we will be fully liable for the incident, providing, as soon as possible, for the shipment of damaged parts COMPLETELY FREE OF CHARGE.
6. SHIPPING AND DELIVERY
6.1. Sognidicristallo Products are shipped, properly packaged, via the best insured express couriers (SDA for Italy, UPS for the European Union, FEDEX for the United States and non-EU countries). Products will be delivered to the address specified by the Customer during the Checkout Procedure. Sognidicristallo offers, as a further delivery option, the possibility for the Customer, by appointment, to collect the Products purchased at the operational headquarters located in Via Castellantico, 17, in Mirano (VE).
6.2. Once the package has been shipped, the tracking code will be sent by email to the address indicated in the Order Proposal to track the shipment, which will be delivered within the times indicated by the courier depending on the country and the destination area.
6.3. Product delivery times may vary depending on the model ordered, the packaging and the place of shipment. In any case, except in the event of force majeure or unforeseeable circumstances, delivery times are on average between 25 and 30 working days from the confirmation of the order (for customised products or the "Ca Rezzonico and Luxury" line, delivery times may vary up to 45 days from the time of order).
6.4. At the time of delivery, it will be the responsibility of the Customer (or a third party delegated by them) to verify that: (i) the number of packages delivered corresponds to that indicated in the transport document; (ii) check the condition of the packaging and its seals, verifying that it is intact, not damaged, not wet or altered in any other way; (iii) sign confirming receipt of delivery; (iiii) where requested by the Courier, present an identity document. Any damage to the packaging or Products must be immediately communicated and contested in writing on the Courier's transport document. Once the transport document has been signed, the Customer may not file any dispute about the external characteristics of the parcel delivered; it remains possible for the Customer to raise disputes relating to the Products as indicated in point 8 below.
6.5. For collection at our headquarters, the Customer must bring with them an identity document and a copy (digital or paper) of the e-mail confirming that the Products are ready for collection.
7. RIGHT OF WITHDRAWAL
7.1. Sognidicristallo extends the right to exercise withdrawal from the contract, without justifying the reason, to 30 (thirty) days (by law this period is imposed to no less than 14 (fourteen) days) from the moment in which the Customer or a delegate other than the carrier, has acquired material possession of the Products. In the event of split shipment, this right of withdrawal will be exercisable from the moment the Customer enters into material possession of the last Product.
7.2. In order to exercise their right of withdrawal, the Customer must inform Sognidicristallo of the decision to withdraw by sending, by post or email, an explicit declaration to this effect. This explicit declaration of the will to withdraw may be sent to the following email address: email@example.com
7.3. In order to comply with the deadline for exercising the right of withdrawal, the Customer must send their explicit declaration before the expiry of 30 (thirty) days starting from the time when the Customer, or a delegate other than the carrier, enters into material possession of the Products.
7.4. Within 10 days of sending the explicit declaration, the Customer must return the purchased products to Sognidicristallo by sending them to the following address: SOGNI srl logistics headquarters in Dolo Via dell'Industria, 5 30031 tel. +390414762538. All return costs and any customs charges shall be borne by the customer. The Products must be returned intact, undamaged and together with all the material present at the time of delivery to the Customer. The Customer will be solely liable for any decrease in the value of the Product resulting from any handling of the Product other than that necessary to establish the nature, characteristics and functioning of the goods.
7.5. Sognidicristallo will reimburse all payments made by the Customer, excluding delivery costs and any customs charges, within 14 (fourteen) days from the day on which Sognidicristallo received the Products returned by the Customer or from the time the Customer provided proof of having returned the Products, whichever occurs first. Refunds will be made using the same method of payment used by the Customer at the time of purchase, unless otherwise agreed.
8. LACK OF CONFORMITY
8.1. In the event that a Product purchased by the Customer does not comply with the sales contract, due to a production defect or any alleged lack of conformity, the Customer has the right to obtain the full restoration of the conformity of the Product purchased.
8.2. The Customer will be required to contact and notify our assistance service of the presence of such lack or defect by writing to us, by mail or email, at the following contacts: SOGNI s.r.l., Via Castellantico, 17 Mirano (VE) firstname.lastname@example.org
8.3. In order to fully restore the conformity of the Product, the Customer may request, at their choosing, the repair or replacement of the non-compliant Product, at no cost to them. In the event that the course of reparation selected by the Customer proves to be impossible or otherwise imposes disproportionate costs on the Seller, the Customer shall be entitled to request a reasonable reduction in the price, proportional to the difference between the value of the goods received and that of the compliant goods, or the termination of the contract.
8.4. The Seller will not be held responsible for any lack of conformity that may occur after 3 (three) years have elapsed from the time of delivery of the Product.
9. GUARANTEE OF AUTHENTICITY AND PROPER FUNCTIONING
9.1. All the products on our website are made by Italian craftsmen and women, according to the ancient glass processing techniques of the Murano masters and are all strictly MADE IN ITALY. Sognidicristallo guarantees the authenticity of all the Products on the Site.
9.2. All Sogni di Cristallo trademarks on the Products, accessories and packaging, as well as all illustrations, images and logos are subject to copyright. These trademarks are and will remain the property of Sognidicristallo.
10. GOVERNING LAW AND PLACE OF JURISDICTION
10.1. The General Terms and Conditions of Sale, as well as any contractual obligations arising from such sales contracts, are governed by the rules of Italian law (in particular Legislative Decree 206/2002 "Consumer Code" and Legislative Decree 70/2003, "E-commerce Code) and must be interpreted on the basis thereof
10.2. All disputes arising from these General Terms and Conditions of Sale will be referred to the jurisdiction of the Court of the Customer's place of residence or domicile.
