1. INTRODUCTION

• 1.1.  These general terms and conditions of sale (hereinafter, the “Terms and Conditions”) govern all sales of Sognidicristallo products (hereinafter, the “Products” or the “Product”) made through the website www.sognidicristallo.com.

• 1.2.  These Terms and Conditions apply to contracts for the purchase of Products concluded at a distance, or in any event away from business premises, between Sognidicristallo (hereinafter also referred to as the “Seller”) and exclusively persons qualifying as consumers who purchase the Products for personal use (hereinafter, the “Customer” or the “Customers”).
  A consumer shall mean any natural person acting for purposes unrelated to their trade, business, craft or professional activity, who is over 18 years of age (or who is otherwise deemed to be of legal age under the laws of their country), as well as minors, provided that they are authorised by their legal representative.

• 1.3.  The resale or transfer of Products purchased on the Website is expressly prohibited when carried out for commercial or professional purposes.

• 1.4.  The languages used to conclude the purchase contract on the Website are as follows: Italian, English, French, German and Spanish.

• 1.5.  Sognidicristallo reserves the right to amend and/or supplement these Terms and Conditions at any time. The purchase of Products is governed by the Terms and Conditions of sale published on the Website and in force at the time of purchase; before making any purchase on the Website, the Customer is required to read these Terms and Conditions carefully.
  Any amendment, supplement or replacement of these Terms and Conditions with an updated version shall automatically render the previous version inapplicable, ineffective and unenforceable against Sognidicristallo in relation to purchases made after such amendment, supplement or replacement.

2. INFORMATION ABOUT THE SELLER AND THE PRODUCTS

• 2.1.  The Seller is SOGNI s.r.l., an Italian company with registered office at Via Castellantico 17 Mirano 30035 (VE), VAT number and tax code no. 04513400277, registered with the Venice Companies Register.

• 2.3.  Information about our Products, including a description of the Product, the relevant technical specifications and any options relating to the Product (such as, for example, the number of lights, colour, dimensions, etc.), is available on the Website.

• 2.4.  The representation of the Products as displayed on the Website may differ from their actual appearance; therefore, before proceeding with the purchase, the Customer must rely on the Product description and the related information.

• 2.5.  In any event, Sognidicristallo shall not be held liable in any way for errors resulting from the Customer’s connection to the Website not functioning properly.

3. CONCLUSION OF THE CONTRACT

• 3.1.  Before submitting an order proposal, the Customer is required to carefully read the characteristics of the item and its price, as well as any other information regarding the Product available on the Website and specifically indicated on the pages relating to each individual Product. The Customer is also required to carefully read these Terms and Conditions and the instructions provided during the purchase procedure.

• 3.2.  To purchase the Products, the Customer must complete the following steps: (i) place the selected Products in the “Cart” by selecting the relevant button; (ii) select the “Proceed to Checkout” button and complete the required mandatory fields (Order Proposal); (iii) select the payment method; (iiii) accept the general terms and conditions; (iiiii) submit the Order Proposal through the Website.

• 3.3.  Before submitting the Order Proposal, the Customer must check all the data entered and, where necessary, may make corrections and/or changes. Once the Order Proposal has been confirmed, the order is sent to Sognidicristallo for processing and may no longer be changed.

• 3.4.  The contract entered into between Sognidicristallo and the Customer shall be deemed concluded when the Customer receives one or more confirmation e-mails (hereinafter, the “Confirmation E-mail”) from Sognidicristallo. The Confirmation E-mail will be sent to the address provided by the Customer during the Checkout procedure and will contain confirmation of the order, together with a summary of the purchase conditions for that order (such as, for example: the Product description; the total price; the contact details to which any complaints may be sent and, more generally, information regarding our after-sales service; the existence of the right of withdrawal and the procedures for exercising it).

• 3.5.  In any event, Sognidicristallo reserves the right not to accept an Order Proposal submitted by a Customer in the following cases: (i) if the Products are unavailable; (ii) where fraudulent or illegal activity is suspected or reported, or where it is suspected that the Products are being purchased for commercial purposes; (iii) where the Customer has previously failed to comply with our General Terms and Conditions of Sale or to fulfil their obligations.
  In such cases, Sognidicristallo will send an e-mail cancelling the orders received within 30 (thirty) days of receipt of the Order Proposal.

• 3.6.  Once the order Confirmation E-mail has been received, the order may no longer be cancelled or changed. Any return of Products must be made in accordance with the procedures set out in Section 7 of these Terms and Conditions.

• 3.7.  The risk of loss of or damage to the purchased Products shall pass to the Customer when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the Products.

4. PRICE AND PAYMENT METHODS

• 4.1. The price of the Products shown on the Website is expressed in euros and includes all applicable taxes and duties, as well as any shipping costs, where applicable, which will be indicated separately. In any event, Sognidicristallo will seek the Customer’s express consent for any additional supplementary costs.

• 4.2.  Although Sognidicristallo regularly checks the accuracy of the prices shown on the Website, it cannot guarantee that they are entirely free from errors. In the rare event that an error is found in the price indicated for a Product, we will immediately reject the order and give the Customer the option to purchase the Product at the correct price. If the error is discovered after the order has been accepted, we will immediately notify the Customer and offer the option to cancel the order.

• 4.3.  The Customer will be charged the price shown in the Cart at the time of confirmation made by selecting the Purchase Button.

• 4.4.  Various payment methods are available for the purchase of our Products. The Customer may pay the amount due and any applicable shipping costs by means of:

• ●  Bank transfer: the details required to transfer the amount due will be sent to the Customer as soon as the order has been completed. Payment must be made no later than ... business days from the order confirmation date. If, after that deadline, the funds corresponding to such amounts are not available in the indicated bank account, Sognidicristallo will not perform the contract and the contract shall be deemed cancelled;

• ●  Paypal: the Customer may conveniently pay the amount due through their Paypal account or by credit card using the world’s most secure online payment system;

• ●  Credit card: the Customer may use their credit card (VISA, Mastercard, American Express) directly on our Website;

• ●  Other methods: in order to meet your needs, Sognidicristallo reserves the right to accept additional payment methods. In such cases, please contact us once the order has been confirmed.

• 4.5.  If the Customer uses a credit card as the payment method, the Customer confirms and warrants that they are the holder of the credit card used and certifies that the information entered during the purchase process is correct, including: the card number, expiry date and, where required, the security code. In any event, Sognidicristallo will charge the transaction to the Customer only after verifying the following conditions: (i) the credit card details; (ii) receipt of charge authorisation from the issuer of the credit card used by the Customer; (iii) confirmation by Sognidicristallo that the Product is available, and in any event only after the order is ready to be processed.

• 4.6.  For payment by the other available methods, the Customer confirms and warrants that they are the holder of the account used for the purchase.

• 4.7.  The purchased Products will be shipped only after the payment of the amount due by the Customer has been successfully completed. If the charge cannot be processed for any reason, Sognidicristallo will notify the Customer that the sale has been cancelled.

• 4.8.  An invoice will be issued for each successfully completed order and will be sent to the Customer by e-mail or post in accordance with applicable law. The invoice will be issued on the basis of the information provided by the Customer at the time of the order. No changes to the invoice will be permitted after it has been issued.

5. PACKAGING

• 5.1. Each Product is professionally packaged using special vacuum-sealed blister packs covered with polystyrene and placed in triple-layer cardboard boxes. In the rare event of breakage during transport, we will assume full responsibility and arrange, as quickly as possible, for the damaged parts to be shipped COMPLETELY FREE OF CHARGE.

6. SHIPPING AND DELIVERY

• 6.1. Sognidicristallo Products are shipped, suitably packaged, through leading insured express couriers (SDA for Italy, UPS for the European Union, FEDEX for the United States and non-EU countries). The Products will be delivered to the address specified by the Customer during the Checkout Procedure. As an additional delivery option, Sognidicristallo offers the Customer the possibility, by prior appointment, to collect the purchased Products from the operating office located at Via Castellantico, 17 a Mirano (VE).

• 6.2.  Once the parcel has been shipped, a tracking code will be sent by e-mail to the address indicated in the Order Proposal so that the Customer can monitor the shipment, which will be delivered within the timeframes indicated by the courier according to the country and destination area.

• 6.3.  Product delivery times may vary depending on the model ordered, the packaging and the shipping destination. In any event, unless events of force majeure or unforeseen circumstances occur, average delivery times are between 25 and 30 business days from order confirmation (for customised Products or Products from the “Ca Rezzonico e Luxury” line, delivery times may be up to 45 days from the date of the order).

• 6.4.  At the time of delivery, the Customer (or a third party appointed by the Customer) must verify that: (i) the number of packages delivered corresponds to the number indicated in the transport document; (ii) the condition of the packaging and the relevant seals is intact, undamaged, dry and not altered in any other way; (iii) the Customer signs to confirm receipt of the delivery; (iiii) where requested by the Courier, the Customer presents an identity document. Any damage to the packaging or the Products must be reported immediately and disputed in writing on the Courier’s transport document. Once the transport document has been signed, the Customer may no longer raise any objection regarding the external characteristics of the delivered parcel; the Customer’s right to raise objections regarding the Products as indicated in Section 8 below remains unaffected.

• 6.5. For collection from our operating office, the Customer must bring an identity document and a copy (digital or paper) of the confirmation e-mail stating that the Products are ready for collection.

N.B. for orders shipped to countries outside the European Community, any customs duties and charges applied by customs shall be borne by the Customer.

7. RIGHT OF WITHDRAWAL

Rules for orders shipped to countries within the European Community

• 7.1. Sognidicristallo extends the period for exercising the right to withdraw from the contract, without stating a reason, to 30 (thirty) days (by law, this period must be no less than 14 (fourteen) days) from the time when the Customer, or a third party appointed by the Customer other than the carrier, takes physical possession of the Products. In the case of split delivery, the right of withdrawal may be exercised from the time when the Customer takes physical possession of the last Product.

• 7.2.  In order to exercise the right of withdrawal, the Customer must inform Sognidicristallo of the decision to withdraw by sending an explicit statement to that effect by post or e-mail. This explicit statement of the intention to withdraw may be sent to the following e-mail address: info@sognidicristallo.com

• 7.3.  In order to comply with the deadline for exercising the right of withdrawal, the Customer must send their explicit statement before the expiry of the 30 (thirty)-day period beginning when the Customer, or a third party appointed by the Customer other than the carrier, takes physical possession of the Products.

• 7.4.  Within 10 days of sending the explicit statement, the Customer must return the purchased Products to Sognidicristallo by sending them to the following address: Sogni srl sede logistica di Dolo via dell’Industria, 5 30031 tel. +390414762538. Unless the Customer chooses a delivery method other than the one provided by Sognidicristallo, the return costs shall be borne entirely by Sognidicristallo. The Products must be returned intact, undamaged and together with all material included when they were delivered to the Customer. The Customer shall be liable for any reduction in the value of the Product resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the Product. 

• 7.5.  Sognidicristallo will refund all payments made by the Customer, including delivery costs, unless the Customer has chosen a delivery method other than the one provided by Sognidicristallo, within 14 (fourteen) days from the day on which Sognidicristallo receives the Products returned by the Customer or from the time when the Customer provides evidence that the Products have been returned, whichever occurs first. Refunds will be made using the same payment method used by the Customer for the purchase, unless otherwise agreed.

Rules for orders shipped to countries outside the European Community

• 7.1. 8. LACK OF CONFORMITY

• 8.1. If a Product purchased by the Customer does not conform to the sales contract due to a manufacturing defect or any alleged lack of conformity, the Customer is entitled to have the purchased Product brought into full conformity.

• 8.3.  In order to have the Product brought into full conformity, the Customer may choose to request the repair or replacement of the non-conforming Product at no cost. If the remedy chosen by the Customer is impossible or would impose disproportionate costs on the Seller, the Customer shall be entitled to request an appropriate price reduction, proportional to the difference between the value of the item received and the value of a conforming item, or termination of the contract.

• 8.4.  The Seller shall not be held liable for any lack of conformity that becomes apparent after 3 (three) years have elapsed from the delivery of the Product.

9. WARRANTY OF AUTHENTICITY AND PROPER FUNCTIONING

• 9.1. All Products available on our Website are made by Italian artisans using the ancient glassmaking techniques of Murano master glassmakers and are strictly MADE IN ITALY. Sognidicristallo guarantees the authenticity of all Products available on the Website.

• 9.2. All Sogni di Cristallo trademarks appearing on the Products, accessories and packaging, as well as all illustrations, images and logos, are protected by copyright. These trademarks are and shall remain the property of Sognidicristallo.

10. GOVERNING LAW AND JURISDICTION

• 10.1.  These General Terms and Conditions of Sale, as well as any contractual obligation arising from such sales contracts, are governed by Italian law (in particular D.lgs 206/2002 “Codice del Consumo” and D. lgs. 70/2003, “Codice dell’e-commerce”) and shall be interpreted accordingly.

• 10.2.  Any disputes arising from these General Terms and Conditions of Sale shall be subject to the jurisdiction of the Court of the Customer’s place of residence or domicile.

• 10.3. Alternatively, we provide the Customer with a link to access the out-of-court dispute resolution platform provided by the European Commission, available at http://ec.europa.eu/odr.
